FISHING VESSEL SINKS OFF WASHINGTON COAST; CREWMAN SAVED

The 34 foot fishing boat ROSIE MARIE sank 20 miles west of the Columbia River Bar on Tuesday. The sole crewman on the vessel was able to get off a May Day message and activate his EPIRB before abandoning the sinking vessel into a life raft. The Coast Guard sent a helicopter from Astoria and a life boat from Cape Disappointment to rescue the man who was hoisted to safety by the helicopter. The crewman was taken to Astoria Oregon for medical examination. The cause of the accident is under investigation. Safety regulations relating to small fishing boats such as this are currently pending, including requirements for life rafts, EPIRB, and immersion suits. This instance again points to the fact that this safety equipment saves the lives of fishermen and the need to make such safety equipment mandatory on all fishing vessels.

Two Fishermen Rescued From Sinking Fishing Vessel Near Narragansett Bay, Rhode Island

The crew of the LUCY M, a 51-foot wooden fishing boat, radioed the Coast Guard they were taking on water and needed help. Two motor life boat crews were dispatched to assist the vessel. Initially, the crew tried to beach the vessel on a shoal, but the task proved too dangerous and the two crewmen were safely removed from the vessel. The vessel subsequently sank in 23 feet of water in the middle of the Point Judith Harbor Refuge about 1,700 yards off the coast of Sandy Hill Cove. Eight feet of the LUCY M remains visible above water, and a reported oil sheen has been observed around the vessel. Initial word was that there were no reports of injuries. Pollution investigators and the Coast Guard are looking into the cause of the accident and need for any remedial measures.

Charter Boat “KID A GIN” Sinks – Manistee, Michigan

A 29-foot charter boat carrying seven people reportedly collided with a pier in fog Saturday and sank. The passengers and crew were able to don life vests prior to abandoning the sinking vessel. Six persons were rescued from the water by a nearby vessel who heard their calls for help. Dense fog causing low visibility is suspected as a contributing factor in the accident. Michael Bachus, a 55 year old retired Marine Corps sergeant major, who reportedly was working as a mate on the KID A GIN, did not survive the accident. The Kid A Gin Charters website indicates that the Captain of the vessel, David Gramza, was a 25 year veteran of fishing on Lake Michigan. There are few safety regulations that apply to the operation of charter vessels such as the KID A GIN, and the Coast Guard indicates decisions about operating in adverse weather conditions are largely left up to the experience of the vessel operator.

One Crewman Lost in Sinking of NORTHERN BELLE - Three Survive Alaska Fishing Boat Sinking

The NORTHERN BELLE crew issued a Mayday call to the Coast Guard at 5:30 p.m. yesterday indicating they were was in trouble and needed help. The crew dawned survival suits but were unable to get into the vessel’s life raft. The Coast Guard arrived on the scene at approximately 8:00 p.m. and pulled all four crewmen from the water. One crewman was pronounced dead upon arrival in Cordova.

The Northern Belle is a 75-foot fishing vessel reportedly owned by Triton Inc. The vessel is home ported in Seattle. The accident happened in the Gulf of Alaska near Prince William Sound. The identities of the surviving crewmen have not yet been released. The casualty will be investigated by the Coast Guard.

Few safety regulations are in place to protect fishing vessel crewmen. Most safety regulations governing small commercial fishing vessels relate to survival equipment rather than preventing accidents from happening. In cases involving injuries and deaths of crewmen on fishing vessels, compensation may be paid under the Jones Act and the Death on the High Seas Act.

The Seattle maritime injury law firm of Beard Stacey & Jacobsen, LLP has extensive experience in handling maritime death and injury cases involving sinking of fishing vessels. The lawyers at Beard Stacey & Jacobsen, LLP handled the fishing vessel sinking cases of the ALEUTIAN ENTERPRISE, ARCTIC ROSE, ALASKA RANGER, KATMAI and many others.

TWO CALIFORNIA FISHERMEN RESCUED FROM SINKING FISHING BOAT

The 34-foot fishing vessel OREGON 350 capsized near Cape Mendocino on Thursday afternoon. Two crewmen, father and son, were rescued from the vessel by the Coast Guard. The vessel reportedly was struck by a large wave, causing the vessel to lose its electronics. After the Coast Guard evacuated one crewman by helicopter, the captain thought he could navigate the vessel to shore using his hand held car GPS system, but the vessel lost stability and capsized. A second Coast Guard helicopter was dispatched to the vessel and rescued the Captain. The Coast Guard recommends that all mariners pay close attention to weather and sea conditions off the Coast of California as conditions can change with little notice. The Coast Guard also recommends that mariners equip their vessels with backup communications and navigation equipment for use in emergencies. Remarkably sophisticated backup navigation and communication equipment can now be purchased very affordably. Every vessel should have back up electronic equipment.

VESSEL SINKS IN WARDS COVE ALASKA

The DIEHLESS, a sixty foot wooden motor vessel built in 1916 sank in Wards Cove, Alaska. The owner of the vessel was on board at the time of the sinking. He reports waking at 4:00 A.M. to the sound of a bilge alarm and discovering the vessel’s back deck awash and the engine room flooded. The owner was able to safely evacuate the vessel. Efforts are underway to contain any environmental damage. It is was estimated the DIEHLESS had 250 gallons of fuel and other oils on board.

The importance of operating bilge alarms cannot be overstated. Bilge alarms should be regularly checked and be properly located, redundant and back up systems should also be considered.

ISLAND TUG AND BARGE SINKS TUG BOAT IN SEATTLE’S DUWAMISH RIVER

The ISLAND WIND, a 65 foot tug boat owned by Island Tug and Barge has sunk at a Seattle dock along the Duwamish River. The vessel reportedly became lodged beneath the dock at low tide causing the vessel to flood as the tide rose. Such sinkings are usually caused by improper mooring of the vessel. The ISLAND WIND had 6,000 gallons of diesel fuel on board and 400 gallons of lube oil. Salvage and pollution containment operations are underway. The accident is hoped to have minimal impact on the environment. The tug was apparently unmanned at the time of the accident.

CREW RESCUED FROM SINKING DREDGE IN WASHINGTON

Three crewmen have been rescued from a dredge taking on water near the Quillayute River near La Push, Washington. The dredge, “Bar Fly,” reportedly got hung up on its anchor and began taking on water, causing the crew to radio the Coast Guard for help. The dredge sank in ten feet of water, and salvage and efforts to limit environmental damage are underway. There were no reported injuries in the accident.

In a recent decision by the United States Supreme Court, crewmen aboard dredges such as the Bar Fly have been declared to be Jones Act seamen and covered by Federal Maritime Law. Maritime employers owe dredge workers a safe place to work and a seaworthy vessel. In almost all accidents such as this one, the accident is preventable if proper safety procedures are followed.

ALASKA FISHERMEN RESCUED FROM SINKING VESSEL

Three fishermen have been rescued from a sinking fishing vessel near Kodiak Island. The crewmen aboard the fishing vessel, Butterfly, reported their vessel was taking on water and their pumps were unable to keep up with the flooding. A nearby fishing vessel, the Tempest, came to the rescue of the sinking vessel’s crew. The Coast Guard lowered additional pumps to the Butterfly, and the Tempest was able to tow the vessel to Old Harbor on Kodiak Island. The cause of the flooding is still under investigation.

SINKING CRAB BOAT TOWED TO CRESCENT CITY

On Wednesday, a small crab fishing vessel with four people on board began taking on water about one mile south of Crescent City Harbor. The Coast Guard responded to the Mayday by dispatching a 47 foot motor life boat, and an MH Dolphin Helicopter from Humbolt Bay. The vessel was stabilized and towed to safety. There were no reported injuries. The flooding of the vessel reportedly occurred through a defect in the vessel’s salt water intake.

Improper maintenance and repairs of vessels can quickly lead to a disaster at sea. Vessels should be equipped with adequate high water alarms and bilge pumps. All vessels and their crews must be trained in abandon ship and survival training before departing port. The Coast Guard provides dockside safety exams for fishing vessels free of charge. These dockside exams for uninspected vessels focus on safety equipments such as epirbs, survival suits, and life rafts.

THREE RESCUED FROM SINKING FISHING VESSEL NEAR COOS BAY OREGON

Three crewman were rescued Tuesday from the 38 foot fishing vessel MANATEE. The vessel began taking on water near the entrance to Coos Bay, Oregon. The United States Coast Guard sent a 47 foot motor life boat to rescue the crewmen. The vessel reportedly sank and an investigation into the cause of the sinking and salvage efforts are underway. Records indicate the MANATEE was built in 1941 and is owned by William Merrit. There are no reported injuries at this time.

The Coos Bay bar entrance is notoriously dangerous in heavy seas and high tides. Studies by the National Transportation and Safety Bureau have identified the Oregon Coast Crab fishery as the most dangerous fishery on the West Coast. Tragedy appears to have been diverted in this case, but safety precautions must be followed at all times to prevent seamen and fishermen lives from being lost.

Three Fishermen Saved By Coast Guard After Vessel Capsized

Three fishermen were saved by the United States Coast Guard after their vessel capsized three miles southeast of Hilo. The fishermen were, luckily, able to retrieve a working cell phone from the vessel and hail a distress call to 911 around 1 a.m. on Wednesday July 15th. Two Coast Guard air crews were immediately dispatched to the location. By the time the fishermen were found, they had drifted 12 miles south of Hilo. All three were safely retrieved and transferred to a Hawaii county emergency medical service team, where they were reported to be in good condition. Charles Turner, a Coast Guard search and rescue coordinator, revealed how lucky it was to reach them via cell phone. “It [the cell phone] probably saved their lives… this case could have turned out a lot worse.”

FOUR ALASKA CRAB FISHERMEN SAVED FROM SINKING VESSEL

Four crewmen from the ICY MIST have been rescued from their sinking vessel by the United States Coast Guard. The ICY MIST reportedly began taking on water early Wednesday morning, and issued a Mayday call that was relayed to the Coast Guard by other nearby fishing vessels. The ICY MIST went aground on the western shore of Akutan Island. Weather conditions were severe with winds reaching up to 120 mph. A Coast Guard MH-60 Jayhawk rescued the crewmen, who were able to make it ashore and climb shore-side cliffs so the Coast Guard helicopter could safely hoist them up. Reported rescued from the vessel are: Dan Oliver; Clint Packer; Kevin Fisner; and Terry Meyer. There was no reported known cause of the vessel distress, and the Coast Guard will be investigating the cause of the accident.

“PACIFIC GLACIER” CREW TRAINING PAYS OFF

The Pacific Glacier, home ported in Seattle, made it back to Dutch Harbor under it’s own power after a fire threatened to destroy it in the Bering Sea.

On February 26th the Pacific Glacier caught fire at sea. First mate, Odd Rotset, summoned fire crews aboard the vessel, who were immediately sent to the area where the alarm indicated. Ships in the area were also notified of the situation taking place onboard. Those crewmen not trained in fire control immediately donned survival suits, and were the first ones evacuated from the vessel.

Within 45 minutes of the fire alarm it became obvious that progress was not being made with the fire. First mate Rotset then contacted the Coast Guard who diverted USCG Cutter Alex Haley to the fire, but it would not arrive for another five hours. Fortunately for the Pacific Glacier, there were more than a dozen ships in the area waiting to help, and they began by evacuating the 90 crew who were not trained to fight fires. Additionally, they provided firefighters and equipment. Without this help, the Pacific Glacier would have quickly used up the breathing equipment they had onboard, greatly falling short of the time they needed to get the fire under control. Without the additional equipment and firefighters, the vessel surely would have been a complete loss.

When the USGC Cutter Alex Haley arrived at midnight, the fire was still being fought onboard. By 6am the fire was finally put out. The crews fought the fire for 12 hours straight, saving the vessel. Crew berths, galley spaces, and two decks were destroyed by the fire – but the Pacific Glacier was still afloat.

Many important lessons were learned in the process of this accident:

• Contacting the Coast Guard early and often is the first of three steps mariners need to take during a shipboard fire.
• Having the necessary equipment and knowing how to use it are key to managing an emergency at sea.
• Training and continued practice is critical. Take all the training and all the repeating drills seriously.
• Partnering with other vessels in the area can be key

Joe Foss Sinks off the Oregon Coast

Wednesday, January 23, 2008 the tugboat Joe Foss sunk in 210 feet of water off the Oregon Coast near Tillamook. All three crew members were rescued by a nearby fishing vessel, the Kilchis, before the Coast Guard transferred them to their station in Tillamook Bay. The tug was believed to be carrying 1300 gallons of fuel when it went down.

A day or two earlier the Joe Foss began taking on water near Neah Bay, Washington and was escorted by the Coast Guard into La Push, WA for repairs.

Fishing Vessel Haeshin Strikes Jetty

January 21, 2008 the 69-foot fishing boat, Haeshin, hit a jetty near Westport, WA and sank into the channel. All three crew members were rescued before the vessel went under in 30 feet of water.

The Haeshin reportedly had 540 gallons of diesel aboard when it sank. Crews were unable to remove the fuel at the time due to conditions. Sonar was later used to try and locate the sunken boat, as it appeared to have drifted from it’s known location. The vessel has not yet been found, and no signs of a diesel spill have been reported.

Lady of Grace Sinking Likely Due to Ice

January 25, 2008 Coast Guard investigators announced that the Lady of Grace capsized and sank on January 26, 2007 likely because of excessive ice buildup on the rigging, making it top heavy.

The Lady of Grace was approximately 12 miles out from Hyannis, Mass when it sank, losing all four New Bedford fishermen aboard. No one saw the sinking or had radio contact with the Lady of Grace at the time of the incident, but vessels in the area at the time provided weather conditions to assist in reconstruction of the incident.

EPIRB Assists in Rescue in Sinking of Lady Blackie

Monday, November 26th, 2007: Lady Blackie, a 90 foot fishing vessel, began taking on water at about 4:45 am in Wide Bay in Shelikof Strait. An EPIRB signal alerted the Coast Guard, who was able to make contact with the boat and learned that the vessel was taking on water and the crew could not access the pumps.

The three men and one woman donned survival suits and boarded the life raft with their dog, Tusk, an additional EPIRB, strobe lights, and a parachute flare. They were located about 30 minutes later by the Coast Guard, in good condition, and were praised for doing all the right things to be found quickly and safely.

Collision in Chatham Strait Under Investigation by Coast Guard

The Spirit of Yorktown, a 257-foot cruise vessel, crashed into a much smaller fishing vessel, the Adirondack, on June 25 in Chatham Strait in southeast Alaska. This is the Spirit of Yorktown’s second mishap in two years, the first occurring when the boat ran aground in Washington State last year. The collision is under investigation by the Coast Guard.

No one was injured in the collision, but Adirondack's steering was disabled and the fishing vessel had to be towed to port. The vessel also sustained damage to its right side and top house. The Spirit of Yorktown reported no damage.

The owner of Adirondack hoped to have his vessel - his livelihood - back on the water within a week of the collision.

If you have been involved in a vessel collision at sea that has resulted either in injury or in damage to your vessel, be sure to find out about your rights under maritime law. Call Beard Stacey Trueb & Jacobsen today for a free consultation, and visit our website.

FISHERMEN RESCUED FROM SINKING VESSEL “RISKY BUSINESS”

March 13, 2007: Five fishermen were hoisted to safety after the 53-foot fishing vessel, Risky Business, became disabled and started to sink.

A 7:48 am call alerted Air Station Kodiak that the Risky Business was listing to port, and was heading to Kodiak. At noon they further reported a mechanical problem, listing of 30 degrees to port, and announced they were planning to abandon ship.

The Coast Guard dispatched a HH-60 Jayhawk helicopter, that arrived just as the vessel was forced on its port side by 20-foot seas and 50 mph winds. The Coast Guard instructed the crewmembers to put on survival suits and enter the water, and they were each hoisted by basket into the helicopter.

The captain and four crewmembers were treated and released. The mechanical trouble is being investigated by the Coast Guard.

Alaska Fishing Boat Ocean Challenger Sinks, 1 Survivor found, 2 Dead and 1 still missing

The 58-foot commercial fishing Ocean Challenger capsized Wednesday in the stormy Pacific Ocean, 90 miles south of Sand Point, Alaska. Four were on board the fishing boat. Moments before the boat capsized, the fishermen launched a life raft, but none of them were able to get in it, overtaken by waves two stories high.

The Ocean Challenger was a longliner and home-ported out of Adak, Alaska. The Ocean Challenger had been fishing for black cod near the Sanak Islands and was traveling back to the Aleutian fishing town of Sand Point when it disappeared into the water.

The survivor, 28-year-old Kevin Ferrell, was the only person wearing a survival suit, the Coast Guard said. The two other men, skipper David “Cowboy” Hasselquist of Hoonah, Alaska and Walter Foster of Westport, Washington, were dead when pulled from the water by a rescue swimmer. The missing man, a 26-year-old Kodiak fisherman, was reportedly not wearing a survival suit, the Coast Guard said

The Coast Guard reported 25-knot winds, 20-foot waves and 48 degrees. The National Weather Service said the water temperature was also about 45 degrees.

The first helicopter, a Jayhawk, arrived about an hour after the distress call. The Coast Guard sent a helicopter, a C-130 airplane and the Coast Guard cutter Munro to the location of the capsized Ocean Challenger. Ferrell was taken to the Cold Bay Clinic in Alaska, about 50 miles away, then to an Anchorage hospital.

The cause of the capsizing is unknown at this time.

Search for Fishing Vessel "Slayer" Called Off

The Coast Guard received a mayday call at 6:54 am Friday morning, March 10th from the 34-foot gillnetter, Slayer. The caller stated, “Going down, two hands on board Port Gardner.”

The hands onboard Slayer were Rick Nebert, 42, of Juneau, and Matthew Young, 18, of Sitka. Rick was the owner/operator of the vessel. Rick’s wife, Jennifer, said that her husband had been longlining for cod near Kake and was headed to Sitka to unload his catch.

Within 50 minutes of the mayday call, a Coast Guard helicopter arrived at the scene, and with the assistance of a nearby vessel, the Aleutian Dream, searched the area. Approximately five miles south of Port Gardner they located a raft, survival suit, and a life ring. Later in the morning an additional HH-60 Jayhawk helicopter and the Coast Guard Cutter, Anacapa, joined in the search. By early afternoon, two Civil Air Patrol aircraft also joined in the effort. On Friday night the Coast Guard used a helicopter equipped with infra red and night vision technology.
